Tax residency in Saint Pierre and Miquelon
An individual is considered tax resident of Saint Pierre and Miquelon if their tax domicile is in the territory under tests aligned with French law: residence is established if any one of the following is met during the year—(i) the individual’s household home (foyer) is in Saint Pierre and Miquelon or, failing that, their principal place of abode/habitual stay is there; (ii) the individual carries on their principal professional activity (employment or self-employment) in Saint Pierre and Miquelon; or (iii) the centre of their economic interests is located in Saint Pierre and Miquelon. There is no statutory day-count threshold; habitual presence is determined on overall facts and circumstances. If none of these conditions is met, the individual is nonresident. In cases of dual residence where an applicable tax treaty covers Saint Pierre and Miquelon, treaty tie-breaker rules (permanent home, centre of vital interests, habitual abode, nationality, then mutual agreement) apply.
