Tax residency in Guadeloupe
Guadeloupe applies the French personal income tax residency rules. An individual is treated as resident of France (which includes Guadeloupe) if any one of the following alternative tests is met: their household’s permanent home (foyer) is in France or their principal place of abode/stay is in France—this is generally presumed when they spend more than 183 days in France during the tax year or, if fewer, when they spend more time there than in any other single country; they carry on a professional activity in France, salaried or not, unless that activity is demonstrably ancillary; or France is the centre of their economic interests (for example, location of main investments, business management, or principal source of income). In addition, French State officials and certain public agents posted abroad are deemed resident if assigned to a jurisdiction that does not subject them to comprehensive personal taxation. These tests are applied with reference to the individual’s household circumstances, and days spent in Guadeloupe count as days in France.
