Tax residency in Lithuania
For Lithuanian personal income tax purposes, the tax period is the calendar year, and an individual is treated as a Lithuanian tax resident for a tax period if any of the following apply: the individual’s permanent place of residence is in Lithuania; the centre of vital interests (personal, social, and economic ties) is in Lithuania; the individual stays in Lithuania for 183 days or more during that tax period; or the individual stays in Lithuania for a total of 280 days or more during two consecutive tax periods and stays for 90 days or more in at least one of those tax periods. If none of these conditions is met for a given tax period, the individual is a non-resident for that period. In cases of dual residence, the applicable double tax treaty tie‑breaker rules determine residency for treaty purposes, generally by reference to permanent home, centre of vital interests, habitual abode, nationality, and mutual agreement.
